The Hunchman Trust – Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern participation in any fundraising challenge, event, or activity (collectively referred to as a “Challenge”) organised by The Hunchman Trust (“we”, “us”, “our”). By signing up for a Challenge, participants (“you”) agree to comply with these Terms in full.

2. Eligibility

To participate in a Challenge, you must:

Be aged 18 or over, or have parental/guardian consent if under 18.

Be medically and physically fit to take part.

Comply with all safety instructions and event-specific requirements.

Submit a completed and signed Participant Waiver Form before the Challenge date. Participation will not be permitted without a signed waiver.

3. Waiver Requirement

All participants are required to sign a waiver of liability before taking part in any Challenge. This waiver confirms that you understand the risks involved and release The Hunchman Trust, its trustees, employees, volunteers, and partners from any liability for injury, loss, or damage arising from your participation.

The waiver must be submitted electronically or in physical form at least 48 hours before the Challenge start time, unless stated otherwise.

4. Personal Responsibility

You accept full responsibility for:

• Ensuring you are medically and physically fit to participate in the Challenge.
• Ensuring your own health and safety throughout the Challenge.
• Following all Challenge guidelines, safety rules, route markings and instructions given by organisers, marshals or Event Control.
• Carrying a working mobile phone with you at all times during the Challenge.
• Staying on the marked route at all times.
• Taking extra care in wet, muddy or otherwise hazardous conditions.
• Avoiding overtaking where sections of the course are narrow or where doing so may create a risk to yourself or others.
• Any costs incurred through injury, travel, insurance or equipment.

Where a Challenge takes place on or alongside public roads, you acknowledge that roads remain open to traffic unless specifically stated otherwise. You must remain alert to vehicles and other road users and comply with normal road and pedestrian rules.

You must cross roads at designated pedestrian crossings where possible and take particular care at any crossings or locations highlighted during the event briefing, including Hampton Court where applicable.

If you witness or are involved in an accident, injury or other incident, you must contact Event Control immediately and follow any instructions given.

If a participant or other person falls into a river or other body of water, do not enter the water to attempt a rescue. Alert Event Control and/or the emergency services immediately and follow the event emergency procedures.

We recommend that you consult your GP before undertaking any physically demanding activity.

5. Insurance

The Hunchman Trust does not provide personal accident or medical insurance. You are advised to arrange your own insurance if necessary.

6. Fundraising

By participating in a Challenge, you agree to make reasonable efforts to meet any fundraising targets communicated to you. All funds raised must be transferred to The Hunchman Trust within 30 days of completing the Challenge.

7. Cancellation or Modification

We reserve the right to:

Cancel or reschedule any Challenge due to circumstances beyond our control (e.g., extreme weather, safety concerns).

Modify the Challenge format, location, or details where necessary.

If a Challenge is cancelled, we will offer alternative dates or a refund of registration fees, where applicable.

Please note – Event tickets are non refundable. 

8. Photography and Media

By taking part in a Challenge, you consent to being photographed or filmed. We may use such media for promotional, fundraising, or awareness purposes across our platforms and publications. If you do not wish to be featured, please notify us in writing prior to the event.

9. Data Protection

Your personal data will be processed in accordance with our Privacy Policy and used only for purposes related to your Challenge participation and The Hunchman Trust’s charitable activities.

10. Liability

Participation in any Challenge involves inherent risks, including the risk of injury, illness, accident or, in extreme circumstances, death. By participating, you acknowledge and accept the risks reasonably associated with the Challenge.

You are responsible for ensuring that you are medically and physically capable of participating and for following all safety instructions, route guidance and directions provided by the organisers.

To the fullest extent permitted by law, The Hunchman Trust, its trustees, employees, volunteers and event partners will not be liable for:

• Injury, illness, loss or damage arising from risks inherent in the Challenge or from a participant’s failure to follow instructions or take reasonable care.
• Loss of or damage to personal belongings, clothing or equipment.
• Losses arising from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence.

Nothing in these Terms affects your statutory rights.

11. Code of Conduct

Participants must behave respectfully toward all organisers, volunteers, fellow participants, and members of the public. We reserve the right to remove any participant from a Challenge for inappropriate or unsafe behaviour.

12. Participant group chats

We may use WhatsApp group chats to communicate important information relating to the Challenge.

By choosing to join a participant WhatsApp group, you acknowledge that your phone number, WhatsApp profile name, profile picture and any information you choose to share may be visible to other members of the group.

Participation in the WhatsApp group is optional. If you do not wish for your details to be visible to other participants, please do not join the group and contact us to arrange an alternative way to receive essential event communications.

The Hunchman Trust is not responsible for how other participants independently use or store information that you choose to make available within the group, except where responsibility cannot lawfully be excluded.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
